The judge ruled the U.T.A. is well within its legal bounds to inform the public about the issues of light rail and mass transit prior to the election.
Salt Lake County Commissioner Brent Overson took the matter to court, claiming the pamplet is politically ill-timed, as voters are about to decide a sales tax increase for transit.
But U.T.A. says the material is not political.
John Inglish/UTA General Manager: "WE'RE REQUIRED BY FEDERAL LAW TO UPDATE IT EVERY YEAR AND OBVIOUSLY WE CAN'T UPDATE IT AND UPGRADE IT UNLESS YOU'RE INFORMING THE PUBLIC ABOUT WHAT IT IS."
Commissioner Overson says he may appeal the decision. He still questions the timing of the pamphlets' release.
